1. General Information
1.1. These Terms and Conditions (hereinafter referred to as "Terms") are a legally binding agreement between the Buyer and ArtByAV.lt (the "Seller"). They outline the rights and obligations of both parties.
1.2. ArtByAV.lt reserves the right to update, modify, or add to these Terms at any time, with changes communicated on the website.

2. Conclusion of the Purchase Agreement
2.1. The purchase agreement between the Buyer and the Seller is concluded when the Buyer places an order for products on the website after reviewing and accepting these Terms.

3. Seller’s Rights
3.1. The Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer in the event of necessary circumstances.
3.2. If the Buyer attempts to disrupt the store’s operations or violates any rules, the Seller has the right to restrict or suspend access to the site without prior notice.

4. Seller’s Responsibilities
4.1. The Seller agrees to make the online store accessible and operate in accordance with these Terms.
4.2. The Seller is responsible for delivering the products ordered by the Buyer, based on the delivery method selected during the checkout process.
4.3. If an ordered product cannot be delivered due to unforeseen circumstances, the Seller may cancel the order and notify the Buyer. The Seller will offer a similar product if available. If the Buyer declines, the paid amount will be refunded within 3 business days.
4.4. If the Buyer returns products in accordance with Section 5.2, the Seller will process a refund within 5 business days.
4.5. A refund will be issued once the returned products are received or the Buyer provides proof of shipment, whichever occurs first.
4.6. If the Buyer purchases an original artwork, a certificate of authenticity confirming the authenticity of the artwork will be provided with the piece.

5. Buyer’s Rights
5.1. The Buyer has the right to purchase products from the online store according to these Terms.
5.2. The Buyer may cancel the purchase agreement by notifying the Seller in writing within 14 calendar days from receipt of the goods.
5.3. The right to cancel applies only if the product is unused and in its original condition, including packaging.

6. Buyer’s Responsibilities
6.1. The Buyer must pay for the purchased products and accept them according to the agreed terms.
6.2. If the Buyer refuses to accept delivery without valid reasons, they will be responsible for the return shipping costs.
6.3. Upon receiving goods, the Buyer should inspect the items and the shipment together with the Seller or delivery person.
6.4. By using this website, the Buyer acknowledges and agrees to these Terms and agrees to abide by them.

7. Product Pricing
7.1. All product prices are listed in Euros. Any applicable delivery charges, if any, will be added at checkout after order confirmation.

8. Ordering and Payment
8.1. The Buyer selects desired products, adds them to the shopping cart, and proceeds to checkout, where they provide necessary personal information such as name, shipping address, and phone number. The Buyer confirms the order and agrees to these Terms.
8.2. Buyers can pay for products in the online store via OPAY or Stripe payment platforms, ensuring secure and convenient transactions.

9. Delivery of Goods
9.1. The Buyer must provide a valid delivery address during checkout.
9.2. The Buyer is responsible for accepting the delivery of goods. If the Buyer cannot be present, the Seller is not liable for delivery errors.
9.3. The Seller will deliver the goods in accordance with the estimated timeframes provided in the product description.
9.4. The Seller is not responsible for discrepancies between the online product images and the actual products due to variations in the monitor used by the Buyer.
9.5. If the Buyer cancels the order, they will receive a full refund, including delivery charges.

10. Returns and Exchanges
10.1. The Buyer may return non-defective goods within 14 days after receipt. If the goods are defective, they will be repaired or replaced according to the provisions of the Lithuanian Civil Code.
10.2. Returned items must meet the following conditions:
10.2.1. The goods should be in their original, undamaged packaging (except for defective items).
10.2.2. The product must be undamaged and unused.
10.2.3. The product must retain its commercial appearance (tags, protective films, etc.).
10.2.4. The returned product must be in the same condition as when it was received.
10.2.5. The Seller reserves the right to refuse the return of goods if conditions are not met.
10.2.6. The return process must be completed within 14 days from the receipt of goods.
10.3. The Buyer will receive a refund for returned goods within 5 days after the item is received back by the Seller, unless agreed otherwise.
10.4. Products made to order or customized according to the buyer's specific requirements cannot be returned, in accordance with Article 6.228(10), Part 2 of the Civil Code of the Republic of Lithuania and Article 16(c) of the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights.

11. Final Provisions
11.1. These Terms are governed by the laws of the Republic of Lithuania.
11.2. Any disputes arising from these Terms will be resolved through negotiations. If an agreement cannot be reached, disputes will be settled according to Lithuanian law.
11.3. Neither party will be held responsible for failing to meet obligations due to unforeseeable circumstances (Force Majeure).
